Terms of Service & Waiver of Liability

PART I — TERMS OF SERVICE

1. About These Terms

1.1 Contractual Relationship

These Terms of Service (the “Terms”) form a legally binding agreement between you and Cuisine Mon Amour LLC, a limited liability company organized under the laws of the State of Washington, operating under the trade name Pâtisserie Mon Amour (“PMA,” “we,” “us,” or “our”).

These Terms govern:

        your access to and use of www.patisseriemonamour.com (the “Site”); and

        your booking of, and participation in, any in-person or online baking or pastry classes, workshops, demonstrations, masterclasses, or related services facilitated through the Site (collectively, the “Services”).

1.2 Acceptance at Checkout

By creating an account, booking a Service, or attending a Service, you confirm that you have read, understood, and agree to be legally bound by:

        these Terms of Service;

        the Waiver of Liability and Assumption of Risks (Part II of this document); and

        the Privacy Policy.

Acceptance occurs electronically by checking the required acceptance box during the online checkout process. Such acceptance constitutes a valid and binding electronic signature under the U.S. E-SIGN Act.

If there is any conflict between these Terms and the Waiver, the Waiver shall prevail with respect to liability and risk allocation.

1.3 Updates

We may modify these Terms at any time. The revised version will be effective as of the updated “Effective Date.” Continued use of the Site or participation in a Service after that date constitutes acceptance of the revised Terms.

2. Definitions

Platform: The digital booking, scheduling, payment, and communication tools operated under the Pâtisserie Mon Amour brand.

Services: Classes, workshops, masterclasses, demonstrations, one-on-one sessions, and related content made available through the Platform.

Instructor: An independent contractor who provides Services through the Platform. Instructors are not employees, agents, or representatives of PMA.

Participant: Any individual who books or attends a Service.

User: Any Participant or Instructor using the Platform.

Content: Recipes, videos, photographs, recordings, text, graphics, class materials, reviews, and other materials made available through the Site or created during a Service.

3. Eligibility, Accounts, and Acceptable Use

3.1 Eligibility

You must be at least 18 years old to create an account or book a Service. Minors may participate only under the supervision and responsibility of a parent or legal guardian, who must accept these Terms and the Waiver on the minor’s behalf.

3.2 Account Responsibility

You agree to provide accurate and complete information, keep your login credentials confidential, and accept responsibility for all activity conducted under your account.

3.3 Acceptable Use

You agree not to:

        use automated scraping, bots, or data collection tools without prior written consent;

        transmit malware, viruses, or harmful code;

        upload unlawful, defamatory, obscene, or infringing content;

        interfere with the Site’s operation or security;

        attempt unauthorized access; or

        use the Site for fraudulent or illegal purposes.

3.4 Enforcement

We may suspend or terminate your account or access to the Site without notice if you violate these Terms or applicable law.

4. Nature of the Platform

4.1 Facilitator Role

PMA operates solely as a technology and booking platform facilitating connections between Participants and independent Instructors.

4.2 Instructor Independence

Instructors operate independently, determine their own curricula and methods, and are solely responsible for the content, quality, safety, and delivery of their Services.

4.3 No Control or Supervision

PMA does not supervise, direct, or control Instructors and is not responsible for their acts or omissions.

5. Intellectual Property and User-Generated Content

5.1 PMA Content

All PMA-provided Content is owned by PMA or its licensors and protected by applicable intellectual property laws.

5.2 Limited License

You are granted a limited, non-exclusive, non-transferable license to use PMA Content for personal, non-commercial purposes only.

5.3 Restrictions

You may not reproduce, distribute, resell, publish, or claim ownership of any Content without prior written consent.

5.4 User Submissions

If you submit reviews, photos, comments, or other content, you grant PMA a worldwide, perpetual, royalty-free license to use, reproduce, modify, publish, and distribute such content for business and marketing purposes. You represent that you have the rights to submit such content.

5.5 Third-Party Links

The Site may contain links to third-party websites. PMA is not responsible for their content or practices.

6. Participant Responsibilities

6.1 Dietary Restrictions

You must notify PMA of any allergies, intolerances, or dietary restrictions before booking by contacting contact@patisseriemonamour.com. Ingredients cannot be modified after booking.

6.2 Equipment and Ingredients

You are responsible for having the required equipment and ingredients. PMA is not liable for failures due to missing or faulty equipment.

6.3 Minors and Guests

You are responsible for the safety and conduct of any minor or guest present during a Service.

6.4 Safe Environment

For online Services, you are responsible for maintaining a safe and hygienic workspace.

7. Safety and Assumption of Risk

Participation in culinary activities involves inherent risks, including burns, cuts, and equipment-related injuries. You voluntarily assume all such risks as further detailed in Part II (Waiver of Liability) of this document.

Failure to follow safety instructions may result in removal without refund.

8. Booking, Cancellation, and Refund Policy

All bookings are final and non-refundable unless expressly stated otherwise in writing.

Late arrivals exceeding 15 minutes are considered no-shows and are not eligible for refunds or rescheduling.

9. Service Operations and Conduct

PMA may substitute an Instructor or reschedule a Service if necessary. PMA is not responsible for venue conditions, third-party kitchens, or participant connectivity issues.

Disruptive or unsafe behavior may result in removal without refund.

Some Services may be recorded. By participating, you consent to such recordings.

10. Ingredients and Supplies

Ingredient lists are provided in advance. Instructors may make reasonable substitutions for availability reasons. You are responsible for your own kitchen tools and equipment.

11. Limitation of Liability

To the maximum extent permitted by law:

        PMA’s total liability is limited to the amount paid for the applicable Service; and

        PMA is not liable for indirect, incidental, consequential, or punitive damages.

Nothing limits liability for gross negligence or intentional misconduct.

12. Indemnification

You agree to indemnify and hold harmless PMA, Cuisine Mon Amour LLC, its Instructors, affiliates, and venues from any claims, damages, losses, or expenses arising from:

        your breach of these Terms or the Waiver;

        your conduct during a Service; or

        injury or damage caused by you or third parties at your location.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Washington, without regard to conflict of laws principles. Any dispute not subject to mandatory arbitration shall be brought exclusively in the state or federal courts located in Washington.

14. Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the AAA under its Consumer Arbitration Rules. Arbitration shall take place in Seattle, Washington, or remotely.

You waive any right to participate in class actions or representative proceedings. The Federal Arbitration Act governs this section.

15. Entire Agreement and Severability

These Terms, the Waiver (Part II), and the Privacy Policy constitute the entire agreement between you and PMA. If any provision is held unenforceable, the remaining provisions shall remain in effect.

PART II — WAIVER OF LIABILITY AND ASSUMPTION OF RISKS

 

This Waiver of Liability and Assumption of Risks forms an integral part of the Terms of Service above. By checking the acceptance box at checkout, you agree to both Part I and Part II.

17. Legal Entity Identification

Pâtisserie Mon Amour is operated by Cuisine Mon Amour LLC, a limited liability company organized under the laws of the State of Washington. Pâtisserie Mon Amour is the commercial and trade name under which Cuisine Mon Amour LLC operates.

18. Important Notice – Intermediary Role

Pâtisserie Mon Amour is a digital platform that acts solely as an intermediary, connecting independent instructors (“Instructors”) with participants (“you” or “Participant”) for pastry and baking classes, workshops, and masterclasses.

Pâtisserie Mon Amour does not provide, supervise, control, or operate the classes themselves and is not responsible for the acts, omissions, instructions, or conduct of any Instructor. All sessions are independently provided and led by the Instructors.

By booking a session through Pâtisserie Mon Amour, you acknowledge and agree that Pâtisserie Mon Amour’s role is strictly limited to facilitating bookings, payments, and access to the platform.

19. Assumption of Risk

You understand and acknowledge that participation in pastry, baking, and culinary activities, whether conducted online or in person, at your home, at an Instructor’s workshop, or at any other location, involves inherent risks, including but not limited to:

        Burns, cuts, slips, or falls

        Use of sharp tools, hot equipment, or appliances

        Food allergies, intolerances, or sensitivities

        Foodborne illness or adverse reactions

        Damage to personal property, kitchens, equipment, or facilities

You voluntarily assume full responsibility for all risks associated with your participation.

20. Participant and Third-Party Responsibility

You agree that:

        You are solely responsible for the safe and proper use of all tools, equipment, and ingredients.

        For online classes or sessions held at your location, you assume responsibility for:

       Your own safety

       The safety of all other persons present, including family members, guests, children, or third parties

       Any injury, loss, or damage to persons or property

        For in-person sessions held at an Instructor’s workshop or venue, you agree to comply with all safety rules and to act responsibly at all times.

21. Minors

Participation by minors is permitted only under the direct supervision and responsibility of a parent or legal guardian. The parent or legal guardian agrees to this Waiver on behalf of the minor and assumes full responsibility for the minor’s participation, safety, and conduct.

22. Waiver and Release of Liability

To the fullest extent permitted by law, you hereby release, waive, and discharge Pâtisserie Mon Amour, Cuisine Mon Amour LLC, its Instructors, officers, employees, contractors, affiliates, and venues from any and all claims, demands, actions, or causes of action arising out of or related to your participation in any session, including claims based on ordinary negligence.

This waiver does not apply to gross negligence or intentional misconduct.

23. Allergies, Health, and No Medical Advice

You confirm that you have disclosed any known allergies, dietary restrictions, or health conditions that may affect your participation.

You understand that no information provided during any session constitutes medical, nutritional, or health advice. You are solely responsible for consulting a qualified professional regarding any medical or dietary concerns.

Neither Pâtisserie Mon Amour nor any Instructor shall be liable for allergic reactions, health incidents, or injuries experienced by you or any third party present, whether or not such third party has signed this Waiver.

24. Equipment and Technical Issues

Pâtisserie Mon Amour and its Instructors are not responsible for malfunctioning or defective equipment, tools, appliances, or internet connectivity issues at any location, including your home or any third-party venue. No refunds or compensation shall be provided due to technical failures or connectivity issues.

25. Delays, Absence, and Force Majeure

Pâtisserie Mon Amour and its Instructors shall not be liable for delays, cancellations, or interruptions caused by events beyond reasonable control, including but not limited to illness, accidents, natural disasters, power outages, governmental restrictions, or technical failures.

26. Indemnification

You agree to indemnify and hold harmless Pâtisserie Mon Amour, Cuisine Mon Amour LLC, its Instructors, staff, contractors, affiliates, and venues from any claims, damages, losses, liabilities, or expenses, including reasonable attorneys’ fees, arising from:

        Your participation

        Your actions or omissions

        The actions of any third party present at your location

        Any breach of this Waiver

27. Use of Image and Likeness

You consent to the use of photographs or videos of you, your culinary creations, or sessions in which you participate for promotional and marketing purposes by Pâtisserie Mon Amour, without compensation.

This consent is optional and not a condition of participation. If you do not wish your image to be used, you must notify Pâtisserie Mon Amour in writing prior to the session at contact@patisseriemonamour.com.

28. User-Generated Content

By submitting reviews, comments, photos, or other content, you grant Pâtisserie Mon Amour a worldwide, perpetual, royalty-free license to use, reproduce, publish, and distribute such content.

29. Electronic Acceptance and Legal Effect

This Waiver is accepted electronically at the time of booking by checking the required acceptance box during the online checkout process.

You agree that such electronic acceptance constitutes a valid and binding electronic signature in accordance with the U.S. E-SIGN Act and applicable law.

This Waiver forms an integral part of the Terms of Service accepted at the time of booking.

30. Governing Law and Venue

This Waiver shall be governed by and construed in accordance with the laws of the State of Washington. Any dispute arising out of or relating to this Waiver shall be brought exclusively in the state or federal courts located within the State of Washington.

31. Severability

If any provision of this Waiver is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
